General terms and conditions of sale

Article 1 — Purpose and scope

These General terms and conditions of sale govern the sale of products by Kintavolana SAS to consumers and professionals via the website kintavolana.com. Placing an order on the website implies unreserved acceptance of these terms.

Article 2 — Seller identification

Kintavolana SAS, a simplified joint-stock company (société par actions simplifiée) with share capital of €1,000, registered with the Paris Trade and Companies Register (RCS) under number 108 878 497, whose registered office is at 25 rue de Ponthieu, 75008 Paris, France.

Article 3 — Products

Kintavolana sells raw, whole natural materials (spices, leaves for infusion, resins, cacao, vanilla, stones). Photographs and descriptions are as accurate as possible but cannot guarantee a perfect match with the product, particularly given the natural and variable character of the materials offered (colour, shape, texture).

Article 4 — Prices

Prices are stated including all taxes, in euros. For customers located in Sweden, prices are displayed and invoiced in Swedish kronor (SEK), converted from the euro price at the exchange rate in force at the time of the order. Delivery costs are shown before the order is finally confirmed.

Article 5 — Orders

The customer confirms the order after checking the contents of the basket. The order is only final once payment has been confirmed. A confirmation email is sent to the customer. Kintavolana reserves the right to cancel or refuse any order from a customer with whom there is a dispute concerning payment for a previous order.

Article 6 — Payment

Payment is due immediately upon ordering. It is made by bank card or any other method offered on the website, via a secure payment platform.

Article 7 — Delivery

France

  • Pickup point (Mondial Relay or Colissimo) — €4.90, free from €49. Estimated delivery: 1 to 2 working days.
  • Home delivery (Colissimo) — €6.90. Estimated delivery: 1 to 2 working days.

European Union

  • Pickup point — €6.90. Estimated delivery: 3 to 5 working days.
  • Home delivery — €9.90. Estimated delivery: 3 to 5 working days.

Sweden

  • Pickup point — 79 SEK. Estimated delivery: 5 to 8 working days.
  • Standard home delivery — 112 SEK. Estimated delivery: 5 to 8 working days.

For pickup point orders, the pickup location is chosen after the order is confirmed, on the confirmation page or by email.

A tracking number is sent by email as soon as the order ships, so the parcel can be followed until delivery.

These times are estimates and start from the date of shipment. Orders are usually processed within 24 to 48 hours. Kintavolana cannot be held responsible for delays caused by the carrier or by events beyond its control (customs, force majeure).

Article 8 — Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, consumer customers have 14 days from receipt of the product to exercise their right of withdrawal, without having to give a reason.

Legal exception (Article L.221-28): the right of withdrawal does not apply to products likely to deteriorate or expire, nor to sealed products unsealed by the customer after delivery which cannot be returned for reasons of hygiene or health protection. This notably concerns food products and natural materials once their packaging has been opened.

Article 9 — Legal guarantees

Every product sold benefits by law, at no extra cost, from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

Article 10 — Liability

Kintavolana cannot be held liable for non-performance of the contract in the event of force majeure, disruption or strikes affecting postal services or means of transport, or any other circumstance beyond its control.

Article 11 — Personal data

The processing of customers' personal data is described in our Privacy policy.

Article 12 — Intellectual property

The content of the website (texts, images, the Kintavolana brand) is protected by intellectual property law and remains the exclusive property of Kintavolana SAS.

Article 13 — Applicable law and disputes

These terms are governed by French law. In the event of a dispute, the customer may use consumer mediation under the conditions set out in Article L.616-1 of the French Consumer Code (see our Legal notice). Failing an amicable resolution, the competent French courts shall have sole jurisdiction.
